Why Replace KITEC pipes?

What are KITEC Pipes?

If you are not familiar with it, KITEC is a brand of plastic piping used in hot and cold water supplies for plumbing fixtures that were sold between 1995 to 2007.  This type of plumbing consists of flexible aluminum pipes between an inner and outer layer of plastic pipe (PEX pipe) with brass fittings.  It was used for potable water, in-floor, and hot-water baseboard heating systems, although it has been identified as weakening over time which resulted in leaks and water damage. KITEC piping is no longer manufactured it has been the result of many lawsuits across North America.
 

A typical hot water boiler is set at a high of 170°F, KITEC was certified to run at a maximum temperature of 180° F. However, there are cases where the coil that heats the water off the main boiler degrades and reduces water temperature, in which homeowners increase the temperature of the hot water system past what it was designed to handle causing the piping to disintegrate.

KITEC Pipe Settlement

The settlement for this class action lawsuit is to be used to pay for the repair of buildings, residences, homes or other structures plumbed with the KITEC system.
 

To apply for payment under the settlement, you must submit a properly completed and timely Claim Form. Claim Forms are available at the following link: Claim Form or you can fill out the “Request Notice Packet” section on the top right of any page.
 

NOTE: To be eligible to receive any money from the Settlement Fund, you must complete and submit the Claim Form accompanying the Notice available on the Case Documents page. The claim filing deadline is January 9, 2020. 
 

If you are unable to provide a sample as suggested on the claims form, you can still send a claim form but you should state the reason why you cannot do so on your claim form and that will be considered with your claim. You should also send documentation showing proof of installation, repairs, or replacement of your KITEC pipe or fittings. 
 

If you have not experienced a leak, you should still file a Claim Form. If there are sufficient funds remaining at the end of the claims filing period, you might be eligible for some compensation. 

How the funds are distributed at the end of the claims filing period depends on the sufficiency of the funds but will most likely be on a pro-rata basis to all those who filed a valid claim. 
 

If after you have filed a Claim Form, you experience a leak, you should file a second Claim Form with information regarding the leak and any related KITEC pipe replacement and removal expenses. 
 

After the Claims Deadline, any funds remaining in the Settlement Fund after all payments to those Class Members filing proper Claim Forms will be returned to the IPEX Funding Entities. Claims made after the Claims Deadline will be rejected.

Based on the information above, it is highly recommended that the KITEC piping be replaced as the piping conditions and fittings worsen over time.
 

It is suggested to replace the KITEC piping with type “L” copper piping which will require access to each in-suite bulkhead and through the floor slab conduits. Another recommendation is to install new ‘Uponor Aqua Pex Pipes’ where piping is within the conduits inside the concrete floor slab to enable easy and quick accessibility. These can be installed by our certified and trained professionals at Aquamaster Drain, Plumbing & Waterproofing Inc.
 

The anticipated cost to retrofit each suite with new “L” Copper/Uponor PEX pipes can range depending on a one-bedroom unit, two-bedroom units or 2+ bedroom units. The cost can start from $5,000 to $6500 for small homes and up to $10,500 for larger homes.  

These prices include the plumbing portion and drywall finishes which do not include finishes where tiles may have to be removed to access the piping.

 

The estimated time may take between 9 to 12 months for an entire building or up to 3 full days for larger homes.  Residents will not be required to move out during the piping replacement. Furnishing may have to be moved away from the work areas that the plumbers may need access to.
